Public Offer of the Online Store glowen.org for the Sale of Goods

This agreement is an official and public offer of the Seller to conclude a sales contract for the Goods presented on the website glowen.org . This agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine, which means its terms are the same for all buyers regardless of their legal status (individual, legal entity, sole proprietor) without giving preference to any particular buyer. By entering into this Agreement, the Buyer fully accepts the terms and conditions of placing an order, payment, delivery, return of goods, liability for improper orders, and all other provisions of the Agreement. The Agreement is considered concluded from the moment the Buyer clicks the "Confirm Order" button on the Checkout page in the "Cart" section and receives an order confirmation from the Seller in electronic form.

1. Definitions

1.1. Public Offer (hereinafter referred to as the "Offer") – a public proposal by the Seller addressed to an indefinite number of persons to conclude a remote sales agreement (hereinafter referred to as the "Agreement") on the terms specified in this Offer.

1.2. Product or Service – the subject of the transaction chosen by the Buyer on the website of the Online Store and placed in the shopping cart or already purchased remotely from the Seller.

1.3. Online Store – the Seller's website at glowen.org, created for concluding retail and wholesale purchase agreements based on the Buyer's acquaintance with the description of Goods provided by the Seller via the Internet.

1.4. Buyer – a legally competent individual over 18 years old who receives information from the Seller, places an order for the purchase of Goods presented on the Online Store website for personal use not related to business activities, or a legal entity or sole proprietor.

1.5. Seller – Borkuta Kostiantyn Serhiiovych (ID code 3533900810), a sole proprietor acting in accordance with the legislation of Ukraine, located in Ternopil, Ukraine.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer agrees to pay for and accept the Goods under the terms of this Agreement.

2.2. The date of conclusion of the Offer Agreement (acceptance of the Offer) and the moment of full and unconditional acceptance by the Buyer of the terms of the Agreement is considered the date of the Buyer's completion of the order form on the Online Store website, provided the Buyer receives order confirmation from the Seller in electronic form. If requested by the Buyer, the Agreement may be executed in written form.

3. Order Placement

3.1. The Buyer places an order independently through the "Cart" form on the Online Store website or by email/phone as indicated in the Contacts section of the Online Store.

3.2. The Seller reserves the right to refuse to fulfill the order if the information provided by the Buyer is incomplete or raises doubts regarding its authenticity.

3.3. When placing an order, the Buyer is required to provide the following necessary information for the Seller to fulfill the order:

  • 3.3.1. Buyer's full name;
  • 3.3.2. Delivery address (if delivery is to the Buyer’s location);
  • 3.3.3. Contact phone number;
  • 3.3.4. Taxpayer ID for legal entities or sole proprietors.

3.4. The name, quantity, article number, and price of the selected Goods are indicated in the Buyer's cart on the Online Store website.

3.5. If either Party to the Agreement needs additional information, they have the right to request it. If the Buyer does not provide the requested information, the Seller is not responsible for providing quality service related to the purchase.

3.6. When placing an order via the Seller's operator (per clause 3.1), the Buyer must provide the information listed in clauses 3.3 – 3.4.

3.7. The Buyer's acceptance of this Offer is confirmed by entering the required data into the registration form or by placing an order via the operator. After that, the Buyer's information is entered into the Seller's database.

3.8. The Buyer is responsible for the accuracy of the information provided when placing the order.

3.9. By accepting the terms of this Offer (placing the order), the Buyer confirms that:

  • a) They are fully informed and agree to the terms of this Offer;
  • b) They consent to the collection, processing, and transfer of their personal data. This consent remains valid for the duration of the Agreement and for an unlimited period thereafter. The Buyer also acknowledges that they are informed of their rights under the Law of Ukraine "On Personal Data Protection," the purpose of data collection, and that the data may be transferred to third parties to fulfill the order without further notice.
